1. Acceptance of Terms & Eligibility
Welcome to Sophia Platform ("the Platform"), an edge-native AI workspace and API ecosystem developed and operated by Four Elements Corp ("Company", "we", "us", or "our").
By accessing or using our website, Cloudflare Edge API endpoints (/api/v1/*), web application dashboard, embeddable widget, or any related services, you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease accessing and using the Platform.
You represent and warrant that you are at least 18 years of age or possess legal parental or guardian consent, and that you have full legal capacity to enter into a binding agreement under applicable jurisdiction.
2. Account Registration & Developer API Key Security
To access certain premium workspaces, AI tools, or developer APIs, you must create an account. You agree to provide accurate, current, and complete information during registration and keep your account details updated.
API Key Responsibility (sk_live_...)
Developer API Keys issued by the Platform (sk_live_...) carry full administrative access to your workspace credits and endpoints. You are solely responsible for maintaining the confidentiality of your API keys. Never commit API keys to public repositories or client-side web bundles.
You are responsible for all activities conducted under your workspace. If you suspect unauthorized access or compromise of your credentials, notify our security team immediately at quangle@fourelementscorp.com.
3. Subscriptions, Stripe Billing & Credit Ledger Rules
Sophia Platform operates on a hybrid subscription and credit ledger model. We offer Free, Pro, and Enterprise subscription tiers billed on a recurring monthly or annual basis via Stripe.
- Automatic Renewal: Paid subscriptions automatically renew at the end of each billing cycle unless cancelled prior to renewal through your billing portal.
- Credit Consumption: AI operations (LLM tokens, audio seconds, image resolutions, and translation segments) consume credits at rates specified in our Public Plans matrix.
- Double-Entry Ledger: All credit allocations and deductions are recorded immutably in our atomic ledger (
credit_ledger_entries) ensuring 100% financial auditability. - Refund Policy: Credits once consumed by successful AI completions are non-refundable. In the event of system errors or queue processing timeouts, our Dead Letter Queue (DLQ) automated reconciliation system issues full credit refunds directly to your workspace wallet.
4. 100% Intellectual Property & Commercial Ownership
Full Customer Ownership Guarantee
As between you and Four Elements Corp, you retain 100% full legal ownership, copyright, and commercial exploitation rights to all outputs, articles, translated segments, audio mixes, and graphics generated by you using Sophia Platform.
Four Elements Corp claims no ownership over your inputs or generated outputs. You grant us only the limited, temporary license to transmit, process, and display your content strictly as necessary to execute the requested AI services across our edge pipeline.
5. Acceptable Use Policy & Content Moderation
You agree not to use Sophia Platform for any unlawful, harmful, or abusive purpose, including but not limited to:
- Generating content that depicts child sexual abuse material (CSAM) or extreme violence.
- Generating malicious software, automated phishing vectors, or cyber exploit scripts.
- Impersonating individuals without their explicit written consent (e.g. non-consensual voice cloning or deepfake generation).
- Bypassing or circumventing rate limits, credit ledger checks, or security authorization guards.
- Attempting to reverse engineer or decompile Cloudflare Worker WASM binaries or proprietary driver interfaces.
Violation of this Acceptable Use Policy may result in immediate suspension or permanent termination of your account without notice or credit refund.
6. Edge Infrastructure & Enterprise SLA (99.9%)
Sophia Platform runs on Cloudflare Workers edge network distributed across 300+ cities worldwide. We endeavor to maintain maximum service availability and sub-20ms edge latency.
For Enterprise tier customers with dedicated Service Level Agreements (SLAs), we guarantee an uptime of 99.9% per calendar month. Scheduled maintenance notified at least 48 hours in advance, acts of God, or upstream third-party AI provider downtime (e.g. OpenAI or Anthropic global outages) are excluded from SLA calculations.
7. Multi-Provider AI Drivers & Service Disclaimers
Sophia Platform provides unified driver abstractions connecting to upstream AI model providers (including Anthropic, OpenAI, Google Gemini, DeepSeek, Fal.ai, and ElevenLabs). While we optimize prompts and stream responses at zero latency, you acknowledge that AI models may occasionally generate inaccurate, offensive, or hallucinated responses. You are responsible for reviewing and verifying all outputs before publishing or making critical business decisions based upon them.
8. Limitation of Liability & Warranty Disclaimer
EXCEPT AS EXPRESSLY PROVIDED HEREIN, THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
IN NO EVENT SHALL FOUR ELEMENTS CORP, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO FOUR ELEMENTS CORP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Suspension & Termination of Service
You may terminate your account at any time via your workspace settings. Upon termination, your right to use the Platform ceases immediately, and your API keys will be invalidated.
We reserve the right to suspend or terminate accounts that breach these Terms, fail payment re-attempts, or pose security risks to other tenants on our multi-tenant edge infrastructure.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through good-faith negotiation. If amicable resolution cannot be reached, the dispute shall be submitted to the competent commercial arbitration center or courts in Ho Chi Minh City, Vietnam.
